BOSCH ONLINE TERMS AND CONDITIONS

1. Introduction

1.1. The website www.bosch-home.com/za/ (“Website”) is owned and operated by BSH Home Appliances Pty Ltd, with registered address at 37 Commerce Crescent, Sandton, Gauteng (“BSH”).

1.2. The provisions contained herein (“Terms and Conditions”) explain the terms and conditions applicable to ordering, sale and delivery of the products, consumables, accessories, and spare parts (“Products”), which are listed on Website.

1.3. By accessing, registering and using the Website, consumers (“You/Your”) will be deemed to be bound by these Terms and Conditions and to have read and accepted these Terms and Conditions, together with the Bosch Privacy Policy, which can be found on the Website.

1.4. When You access or use the Website, You warrant and undertake that You:

1.4.1. are over the age of 18 or assisted by Your legal guardian and that You will not access or use the Website for any purpose that is unlawful or prohibited by any applicable laws, the provisions of these Terms and Conditions and/or any notice displayed on the Website. Any unauthorised commercial use of the Website and its services and/or the resale of the Products and services, is expressly prohibited;

1.4.2. will not use any software, device and/or other instrument to interfere or attempt to interfere with the proper working and functioning of the Website and You will not use any spider, robot, other automatic device and/or manual process to monitor, copy, distribute or modify the Website or the information contained on the Website.

1.5. When You access or use the Website, register an account, conclude a purchase or transaction, sign up for a Bosch newsletter, opt in to marketing communication and/or send an email to Bosch, You agree to receive electronic communications from Bosch, provided that You are entitled to “opt out” at any time by using the applicable “opt out” option.

2. Purchasing Products

2.1. All Products displayed on the Website are limited and are subject to availability. BSH will make all reasonable attempts to ensure that when Products are no longer available, the applicable item is discontinued on the Website or shown as being “out of stock”.

2.2. If BSH is unable to fulfil Your order because the Product is sold out at the time of processing Your order, BSH will inform You and You will be entitled to a reimbursement of the South African Rand (“Rand”) value You paid for the Product, which will be reimbursed by crediting the credit card used to make payment for the Product. BSH reserves the right to communicate Product changes to You on the Website, as and when required.

2.3. BSH will take all reasonable efforts to accurately display prices and service and delivery charges, however, in the event that a Product or service is offered at an erroneous price due to an inadvertent or obvious error and/or fraudulent activity or an incorrect service or delivery cost is displayed, BSH is not obliged to supply the Products or service at the incorrect price and/or service or delivery fee.

2.4. An agreement of sale shall be deemed to have come into effect once You have submitted a fully completed online order form, the Product is in stock and payment has been authorised and/or received by BSH into its bank account. If a selected Product goes out of stock before the sale is concluded, BSH may remove the Product from Your basket.

2.5. The tax invoice applicable to your purchase will be available online in your Website account and a delivery note will accompany your order.

2.6. You are not able to reserve Products to be bought at a later stage and placing an item in your basket or adding an item to a “Wish List”, without fully completing the order, as contemplated above, does not amount to a sale or an order.

3. Cancelling Orders

3.1. After dispatch of an order, You cannot cancel the order.

4. Prices

4.1. The price of each Product is displayed under the Product on the Website and includes value added tax at the applicable rate.

4.2. Any delivery, connection and/or installation charges (if applicable) are not included in the Product prices and if applicable, will be separately indicated on checkout.

5. Payment

5.1. You can pay for the Products using a Visa or Mastercard credit card and all payment transactions are encrypted using appropriate encryption technology.

5.2. By making a Product purchase You authorise BSH to charge Your credit card for the price of the ordered Product and any other charges which are applicable to Your order.

5.3. Payments are collected on BSH’s behalf by PayU an approved payment gateway for all South African acquiring banks. Your details will be stored by BSH separately from the credit card details, which You enter on the PayU secure site. Further details relating to PayU can be found at https://southafrica.payu.com/

5.4. The merchant outlet country at the time of presenting payment options to You, is South Africa and the transaction currency is Rand.

5.5. BSH will not be liable for any loss incurred by You as a result of fraudulent transactions occurring on Your account due to You entering Your credit card details on the Website.

6. Delivery

6.1. Your order will be delivered to the delivery address You specify in Your order and only to physical addresses in South Africa. BSH uses different logistics partners for the delivery of the various Products and accordingly, depending on the Products You order, You may have multiple deliveries for the same order.

6.2. Delivery charges will be calculated on checkout and will be calculated based on the location of Your delivery address.

6.3. Your Order will be delivered no later than 10 business days from the date upon which BSH confirms Your order, except for deliveries over Black Friday and Cyber Monday, which may take up to 12 business days.

6.4. You are fully responsible for ensuring that the dimensions and features of the Products which You purchase are appropriate for installation and use at Your premises.

6.5. Large Appliances.

6.5.1. "Large Appliances" being refrigerators, freezers, washing machines, dryers, washer dryers, dishwashers, built-in chimneys/hoods, ovens, gas hobs and microwave ovens, which require installation.

6.5.2. Prior to the delivery of any Large Appliances, You must ensure that there is clear access for the delivery vehicle and trolleys, which may be used to deliver the Large Appliance and that the width and height of all doorways and walkways are wide and high enough for the Large Appliance to fit through. You must ensure that any area where the Large Appliance will be placed is clear and unobstructed and You must cover any floors to prevent scratching and damage being caused during the delivery of the Large Appliance. BSH will not be liable for any loss or damage which may be suffered or incurred during, or as a result of, the delivery of Large Appliances .

6.5.3. A 10% handling fee will be charged if there is a delivery failure due to no one being home or if the logistics company is unable to deliver due to any points in 6.5.2

7. Obligation to Inspect and Returns

7.1. You must inspect the packaged Products on delivery and if the delivered Product has visible damages or is not correct, You must contact BSH by emailing za_o_online@bshg.com, no later than:

7.1.1. 48 hours after delivery of the Product which is an accessory, consumable or spare part;

7.1.2. 72 hours after delivery in the case of all other Products.

7.2. When contacting BSH You must provide a copy of Your invoice and pictures of any damaged Products.

7.3. Provided that You have contacted BSH within the time periods set out above and Your request is valid and genuine, BSH will, at its sole discretion, proceed with providing a replacement or refund.

7.4. Should You not contact BSH within the timeframes set out above, the Products will be deemed to have been delivered and accepted by You in an acceptable condition.

7.5. If Your Product has a manufacturing defect, You must contact Bosch customer care at 0860026724 and Your claim will be addressed in accordance with the warranty applicable to the defective Product.

7.6. Where the defective Product does not have a specific manufacturer warranty, You can return the defective Product, for a replacement, repair or refund, within 6 months of the date of delivery by contacting Bosch customer care at 0860026724, provided that the aforesaid warranty period shall not apply in circumstances where :

7.6.1. You have caused the defect, damage or fault in the Products;

7.6.2. the defect, fault or damage is as a result of normal wear and tear, negligence or damage arising from misuse and/or improper or inadequate care of the Products and/or where the Products or any parts thereof have been altered and/or dealt with or used contrary to the manufacturer’s instructions.

7.6.3. It should be noted that the manufacturer has the right to assess the unit prior to any action being taken as stipulated above.

7.7. Refunds may take up 30 days to reflect in your account after the refund is initiated by BSH and any agreed refunds will be made to the credit card used to pay for the initial Product purchase.

7.8. Bosch will not accept any Product returns except as provided above.

8. After Sales Service and Warranty

8.1. All Products are supplied subject to the relevant Product's specifications as specified in the Product manuals and are covered by the applicable BSH manufacturer's warranty, the terms and conditions, warranty periods and details of which can be found at https://www.bosch-home.com/za/customer-service/bosch-za-warranty

8.2. In order to claim under the Product warranty, You must have complied with the applicable Product warranty terms and conditions and provided BSH with the applicable Product proof of purchase and the warranty card. The Product warranty is only provided to You, as the initial purchaser of the Product and not to any subsequent owners of the Products.

8.3. Accessories, consumable and spare parts which You may purchase, do not contain any warranty, except when the product instruction manual specifically provides for a warranty.

9. Data Protection and Privacy

BSH will take all reasonable measure to protect Your personal information, data and privacy in accordance with our privacy policy which can be accessed at https://www.bosch-home.com/za/legal/imprint/data-privacy-statement.

10. Events Outside BSH’s Control

10.1. BSH will not be liable or responsible for any failure to perform or for the delay in any performance which is caused by events outside of BSH’s reasonable control, which include, without limitation, acts of God, riots, lock-outs, strikes, government restrictions, floods, fire or other natural disasters.

10.2. BSH may cancel Your order or any unfulfilled part thereof and refund You any money paid towards the cancelled order or extend the time for its performance or completion caused by any event contemplated above.

11. Complaints

11.1. If you have a complaint about the Products or the delivery thereof you can contact the BSH call centre on 0860026724 during working hours on all business days or email bsh@iopen.co.za or complete an online complaints form accessible at https://www.bosch-home.com/za/customer-service/contact-us

11.2. If you are not satisfied with the outcome of the complaint or the handling thereof, you can contact the Consumer Goods and Services Ombud for assistance. Their website can be found at http:www.cgso.org.za/ or you can contact them on 0860 000 272 or email complaints@cgso.org.za.

12. General

12.1. When using the Website, You accept and expressly agree that communication with BSH will be electronic and that BSH will contact You by e-mail or provide You with information by posting notices on the Website.

12.2. As required in terms of the Electronic Communications and Transactions Act, 25 of 2002, BSH’s information is as set out in these Terms and Conditions.

12.3. BSH reserves the right to change these Terms and Conditions or any part thereof, at its own discretion and it will be Your responsibility to ensure that You read the Terms and Conditions and are satisfied therewith when making a purchase on the Website.

12.4. Any changes to the Terms and Conditions will become effective when they have been posted on the Website and it is Your obligation to check the Terms and Conditions for changes and/or updates when making a purchase.

12.5. If You continue to make use of the Website following the posting of changes and/or updates to the Terms and Conditions, you will be deemed to have accepted the changes and/or updates and will be bound by the amended and/or updated Terms and Conditions.

12.6. For all purposes under these Terms and Conditions, BSH chooses as its domicilium citandi et executandi at 37 Commerce Crescent, Gauteng.

12.7. These Terms and Conditions will be construed and governed in accordance with the laws of the Republic of South Africa.
